1. About these terms
These terms govern use of the Chanuka General Trading (Pty) Ltd website and its RFQ submission service. A formal quotation, accepted order or written supply agreement may contain additional terms. If there is a conflict, the terms in the accepted formal quotation or agreement will govern the transaction.
2. An RFQ is not an order
Submitting an RFQ, product list or existing quotation does not create an order, guarantee supply, reserve stock or bind Chanuka General Trading (Pty) Ltd to a price. We may request clarification, decline a request or quote only part of a requirement.
3. Accuracy of information
You are responsible for providing complete and accurate specifications, quantities, brands or acceptable alternatives, delivery information and deadlines. We are not responsible for errors caused by incomplete, unclear or incorrect information supplied to us.
4. Quotations
Prices, lead times, stock and delivery are subject to the validity period and conditions stated in the formal quotation. Unless expressly stated otherwise, quotations are subject to supplier availability and final verification. VAT and delivery treatment will be shown in the formal quotation.
5. Complete and partial orders
Package pricing or discounts may apply only when all listed items and quantities are ordered together. Partial orders, changed quantities or cherry-picked items may be repriced and may attract revised delivery charges.
6. Payment and fulfilment
No order will be processed until the payment required by the accepted quotation has cleared, unless written credit terms have been approved. Proof of payment is not the same as cleared funds. Fulfilment begins only after order acceptance and payment requirements have been met.
7. Alternatives and special orders
Equivalent or substitute products will only be supplied where permitted by the RFQ or approved by the customer. Special-order, customised or non-standard items may be non-cancellable and non-returnable to the extent permitted by applicable law; the formal quotation will identify relevant conditions.
8. Delivery
Delivery dates are estimates unless expressly guaranteed in writing. Delays may arise from supplier availability, transport, incorrect delivery information or events beyond reasonable control. Risk, inspection and delivery terms will be stated in the accepted quotation where applicable.
9. Website and uploaded documents
You may upload only documents you are authorised to share. Do not upload unlawful content, malware, third-party confidential material without authority, or unnecessary sensitive personal information. We may reject or remove submissions that create security, legal or operational risk.
10. Liability and applicable law
Nothing in these terms excludes rights or liabilities that cannot lawfully be excluded. To the extent permitted by law, Chanuka General Trading (Pty) Ltd is not liable for indirect or consequential loss arising only from use of the website or reliance on preliminary information. South African law applies.
